You Can Get More Than Workers' Compensation Benefits
If you were injured on the job, you may be eligible for workers' compensation benefits. You also may be entitled to obtain damages by filing a claim under New York Labor Law 240 or New York Labor Law 241.
NYS Labor Law 240
Also known as the scaffold law, it was enacted in 1885 to protect workers who work on scaffolding, ladders, roofs and other environments where height could play a factor in work injuries. If you have been injured in a fall on a construction site, you may be able to pursue a 240 claim in order to secure additional benefits. These cases generally involve falls from scaffolds, ladders, roofs, pump jack/pick assemblies, man lifts or injuries caused by falling objects while being hoisted. Negligence can often be established by showing that required safety devices were not provided by the owner or contractor in control of the site or work being performed.
NYS Labor Law 241
If you were injured while excavating, doing demolition work or performing other tasks in a building undergoing construction, you may be entitled to benefits under New York Labor Law 241.
